Agreement
These Terms of Service (the “Terms”) apply when you use unopostproduction.com (the “Site”) and when you hire us for retouching, color correction, post-production, prepress or print file preparation (the “Services”). By using the Site or approving a quote, you agree to these Terms. If you agree on behalf of a company, you confirm that you can bind it. Our Privacy Policy explains how we handle personal information.
About Us
The Site and the Services are provided by VIPPIE LLC, a New York limited liability company doing business as UNOPOSTPRODUCTION (“we”, “us”). You can reach us at [email protected].
Using the Website
The Site's design, layout, text, code and trademarks belong to VIPPIE LLC and are protected by copyright and trademark law.
Portfolio images on the Site belong to their photographers, agencies, brands or other rights holders, and are shown to illustrate our work. You may not download, copy, share or use them for any purpose without the written consent of the rights holder.
You may not use the Site or its content to train, fine-tune or evaluate machine learning or generative AI models, or scrape, bulk download or systematically copy it, without written consent from us and the relevant rights holders.
Our Services
We retouch, color correct and prepare images for photographers, agencies, brands and publishers. Each project's scope, price, turnaround and included revisions are set in the quote we send you by email. If a quote and these Terms disagree, the quote applies for that project.
Quotes and Orders
A quote is based on the images, brief and deliverables you describe. A project starts when you approve the quote in writing, and an email is enough. If the brief, the number of images or the deliverables change, we'll tell you how that affects the price and timing before we continue.
Your Images and Materials
You keep all rights in the images, files and references you send us, and we use them only for your project. You confirm that you own them or have permission to have them edited, including any model, property and location releases, and that our work on them as you direct won't infringe anyone's rights.
If someone makes a claim against us because of materials you sent or how you use the finished work, you agree to cover our reasonable costs, including legal fees.
Finished Work
Once you have paid in full, you may use the finished files for any purpose, and we transfer to you any rights we have in our edits to them. Our techniques, tools, presets and know-how stay ours. We don't show unpublished work or before-and-after versions without your written permission. We may show finished images in our portfolio after they have been published, unless you ask us not to.
Confidentiality
We keep your files, briefs and unreleased work confidential. Only our team, the contractors working on your project and the services we use to store and transfer files have access to them, and they must keep them confidential too. We share them with no one else unless you agree or the law requires it.
Payment
We usually invoice in US dollars, and can invoice in another currency when the quote says so. You pay each invoice in the currency it states, by its due date, using a payment method it lists. Prices don't include taxes, which are added to the invoice where they apply. While an invoice is overdue, we may pause work or hold final files until it is paid.
Revisions and Approval
Each quote says how many rounds of revisions are included. A revision is a change within the original brief. New requests or changes to the brief may cost extra, and we'll confirm the cost before we start. Please check delivered files promptly and tell us about any problem, so we can fix it.
Turnaround and Delivery
Turnaround times are estimates based on the number of images and our workload, counted from when we have everything we need to start. We'll tell you if a date changes. We aren't responsible for delays caused by late or incomplete materials, changes to the brief or events outside our control. We deliver files by download link. Please keep your own copies: we keep project files only for a limited time after delivery and may delete them after that.
Cancellation
You can cancel a project at any time by telling us in writing. You pay for the work done up to that point, and we deliver that work once it is paid. We may cancel a project if the materials can't be worked on or these Terms are broken, and we'll refund anything you paid for work we haven't done.
Disclaimers
We do the work with professional care and skill. Beyond that, the Site and the Services are provided “as is”, without other warranties, express or implied, to the extent the law allows. The portfolio shows past work and isn't a guarantee of a particular result. We don't promise that the Site will always be available or free of errors.
Limitation of Liability
To the extent the law allows, our total liability for any claim about the Services is limited to the fees you paid us for the project the claim is about. VIPPIE LLC and its members, employees and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible.
Governing Law & Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute about these Terms, the Site or the Services shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Changes to These Terms
We may update these Terms from time to time. The new version applies from the date at the top of this page. A project you have already approved stays under the version in force when you approved its quote.
